Your Agreement Part 1–
How It Works
What You Are Getting
What You Can Do
What You Can’t Do
October 2012
1.
What is this Agreement all about?
This Agreement is a legal document and it is legally binding
on you and us (Global Gossip). In it
you will find information you need about what you can do and can’t do with your
Global Gossip mobile and what it costs and what you are legally obliged to do
and not do because you have an Australian Mobile Service.
You can get a copy of this agreement by
downloading this document or by phoning 1300 73 83 53 (Customer
Service).
2.
What am I agreeing to and when does
it start?
You Agreement with us includes everything in
this document and any other document that this document talks about or refers
to.
As soon as you activate your Global Gossip SIM
to access the Global Gossip Mobile Services, you agree to all the terms and
conditions contained in this document, the document called “Your Agreement Part

other document that is referred to in this document. This Agreement starts when
you activating your Global Gossip SIM.
3.
What is Global Gossip Mobile Service
Global Gossip mobile service is a mobile telecommunications service. You can find
out what it can do and can’t do by reading this document.
4.
Will it work everywhere and all the time?
No. No mobile service is perfect and
we don’t tell you that ours is. It is not free from faults or interruptions and
it is only usable in the areas covered by Vodafone’s service. Some of the things you can normally
do with this service you will not be able to do if the person you are
communicating with isn’t in an area where they can receive that service or isn’t
using a device or carrier service that will receive that service.
5.
What is the coverage of Global
Gossip’s Mobile Service?
Global Gossip’s Mobile Service is available in the Vodafone
Network Coverage Area. For the latest information on coverage, visit the
Vodafone Australia website at
www.vodafone.com.au/coverage.
Who provides Global Gossip’s Mobile Service?
Global Gossip’s Mobile Services are
provided by Global Gossip Communications Pty Ltd and not Vodafone and, except to
the extent required by law, Vodafone is not liable to you in respect of any of
Global Gossip’s Mobile Services and you undertake to make no claim against
Vodafone in respect of any Global Gossip services.
6.

a)
You can make calls from your mobile phone to both mobile
phones and landline phones in Australia and overseas (International calls)
b)

c)
You can send and receive data and text messages (SMS) and
multimedia messages (MMS)

Service?
a)
You
can’t use the Mobile Service (and you can’t allow any other person to use the
Mobile Service) for an improper or illegal purpose;
b)

an offense.
These are not the only special legal requirements
there are others further in this Agreement which binds both you and Global
Gossip.
8.
Are there other things I cannot do
with my Global Gossip Mobile Service?
Yes. Here are some of those things
and you will find other things elsewhere in this agreement:
a)
You
can’t make or receive calls to or from satellite services
b)
You
can’t make calls to a number that automatically calls a second number or
connects to a second service (what is called a “redialling service” such as a
phone card service). The only
exception to this is accessing your Global Gossip Mobile Service Voicemail
c)
You
can’t use this Service for business or commercial purposes
d)
You
can’t make conference calls or multi party calls
9.
How do I activate my SIM?
When you obtain a Global Gossip
prepaid SIM you can activate the SIM in two ways: online or by calling Customer
Service on 1300 73 83 53. You must have a valid ID to activate your Service.
Your Global Gossip SIM will be connected
to a Global Gossip Card to which you
will need to add credit in order to use your Global Gossip SIM and the Mobile
Services.
10.
What is the Global Gossip Card and
how does it work?
The Global Gossip Card is your way
of paying for your Global Gossip services; it allows you to use
the Global Gossip Mobile Services
providing there is money stored on the account.
It has a unique serial number and PIN and by adding credit to your Global
Gossip account you can pay for Global Gossip internet access, access to the
Global Gossip calling card platform or Mobile Services on your Global Gossip
SIM. This agreement does not contain
information about Global Gossip internet access or the calling card platform. That information can be found at
www.globalgossip.com.
How do I Top-up my Global Gossip account?
1.
Online at globalgossip.com (you will need a credit card)
2.
By
text message (SMS) to 0410 467 747 (0410 GOSSIP). You will need to go to
globalgossip.com and top-up your account first or contact Customer Service to
set up this service. Text “TOPUP XX YYYY” to 0410 467 747, where “XX” is the
recharge amount and “YYYY” is the last four digits of your credit card.
3.
At
any Global Gossip store or hostel with Connect internet access.
For Connect locations please check
globalgossip.com/locations
4.
At
any epay location throughout Australia
5.
By
calling the Customer Service either 1300 73 83 53 or 126789 from your Global
Gossip mobile phone
We will not accept a recharge of
your account that would lift your balance to more than $9,000.
11.
How long does credit last when I Top-up my account?
Your credit will last 180 days from the last use or Top-up. As long as you use your account for
one of the Global Gossip Services during that time, the 180 days will start from
that last time you have used the account to pay for a Global Gossip Service or
Top-up the account with more credit.
If you do not use the account for 180 days you will lose whatever credit remains
on the account. 180 day credit expiry applies only to internet, phonecard and
PAYG mobile credit. If you use
credit to buy an Animal Pack that Animal Pack will last 30 days from the
date of purchase. Animal Packs are
explained in
“Your Agreement Part 2 – Charges and rates and things that relate to the
charges and rates”.
How do I make International Calls?
You can make International calls by
dialling 0011 or + from your mobile and then dialling the number. To access International calls you
must have Caller ID (also known as CID or CNID) activated on your mobile device.
Sometimes your International calls
may not be successful due to carrier restrictions and international carrier
issues and we may not have any control over the quality of this service. In
these circumstances and you accept that Global Gossip is not responsible for
these call failures.
Other Important Things
you Need to Know, Understand and Agree To
12.
What happens if my Global Gossip
account has no credit or goes into a negative balance?
If your Global Gossip account
doesn’t have enough credit for you to use a Mobile Service, you will not be able
to use that service or the service may be cut off before you finish using it. If we have allowed you to have a
negative balance on your Global Gossip account, as soon as you Top-up your
Global Gossip account, any credit amount will be used to pay us back and bring
that negative balance into credit again before you will be able to use any of
the Global Gossip Services.
13.
What happens if I lose my Global
Gossip Card or my PIN?
You are responsible for the security
of your Global Gossip Card and/or your PIN.
Global Gossip does not accept any responsibility whatsoever or under any
circumstances for the security of your Global Gossip Card or your PIN. Any person with knowledge of your PIN
or in possession of your Global Gossip card can have access to your personal
information, can use the credit on your account to access the internet, make
international calls or use any service attached or associated with your account.
You accept and understand that
Global Gossip may make changes to personal information on behalf of any person
or persons in possession of a PIN or Global Gossip Card, and/or permit any
person or persons in possession of the PIN or Global Gossip Card to access any
of the associated services. You
understand and accept that Global Gossip can and will reasonably assume that
possession of the Global Gossip Card or PIN may constitute ownership of the
account and any associated funds.
Should you reveal your PIN to any other person you are deemed by Global Gossip
to have authorised that person to have access to and manage your credit, account
and all other Global Gossip services with you.
If your Global Gossip Card has been
lost or stolen or that some person has gained knowledge of your PIN, you must
tell us straight away or as soon as you become aware of it. Providing we can prove your identity
by other means (which must include a valid photo ID such as a current passport
or current driver’s license), we will give you a new Global Gossip Card or PIN
and transfer all the associated credit and services, at your written request, to
your new Global Gossip account.
Global Gossip may charge for the administration costs involved in doing this for
you.
14.
Can we change our charges and rates?
Yes we can. We can change some of
the charges and rates from time to time. We will try our best to give you 30
days notice of changes to charges and rates. Also, sometimes, you may be
eligible to be a part of a special promotion or offer. Whether you can be a part of a
special offer or promotion will depend on that offer’s terms and conditions
which you will be able to find at
www.globalgossip.com.
15.
Can we make changes to your Agreement?
Yes. We can make changes to the
charges and rates, expiry periods and features of the Mobile Service and the way
the Mobile Service works.
16.
How do we notify you of changes to
our Agreement?
If we make any changes to your
agreement with us, we will tell you of the changes to the agreement either by
putting a notice on
www.globalgossip.com that there is a change to the Agreement, by
emailing you, or by sending you a text message (SMS).
17.
Do I have any other obligations?
Yes.
There are certain things you must agree to in addition to the “Can Do”
and “Can’t Do” listed above.
a.
You
must pay us all the Charges (and taxes) incurred by using the Mobile Service via
Your SIM card, even if those Charges are incurred by someone else (with or
without Your knowledge and/or consent).
b.
You
must provide us with a valid email address and notify us of any changes to that
email address.
18.
What do I need if I am using
3G/GPRS?
You will need a compatible handset
or device to use 3G services and GPRS such as Mobile TV, Full Track Music
downloads and some games, PXT® and Video PXT®, Video Calling and other special
services. You will also need to be within certain coverage areas to use these
services. Certain services, such as video calling and PXT® also require the
person you are calling to have a compatible handset and be within certain
coverage areas. Some special services may not available. Limited content is available with 2G and 2.5G
handsets. Global Gossip reserves the right to modify or withdraw advertised
content services at any time without notice.
You are responsible for all
equipment and software necessary to use the GPRS or 3G network as well as for
the security and integrity of any information that you transmit or receive.
Neither Global Gossip (nor any of its related Bodies Corporate) nor Vodafone
(nor any of its related Bodies Corporate) have any responsibility whatsoever for
the material, data or information you transmit or receive and that you transmit
and receive such material at your own risk.
You accept and acknowledge that
neither Global Gossip (nor any of its related Bodies Corporate) nor Vodafone
(nor any of its related Bodies Corporate) checks or is obligated to monitor the
content of information or material available from the GPRS or 3G network or the
internet, and that neither Global Gossip (nor any of its related Bodies
Corporate) nor Vodafone (nor any of its related Bodies Corporate) are liable for
loss suffered by you or any other person as a result of using information or
material obtained using the GPRS or the 3G network on the internet, including,
but not limited to, loss caused by a virus.
19.
What if I lose my SIM or it is
stolen?
You can ask us to block Your Mobile Phone at the same time, or within one month
after, you tell us that your SIM card has been lost or stolen. If we block Your
Mobile Phone it will not be able to be used on the Vodafone Network to make or
receive voice calls (except calls to emergency "000" and "112" numbers); or send
or receive TXT messages, MMS or Video or Content or any other of the Global
Gossip mobile Services.
We will block Your Mobile Phone if you ask us to. BUT we will not block Your
Mobile Phone if we know the handset shares an international mobile equipment
identity (IMEI) number with another mobile handset or device connected to
the Global Gossip or Vodafone Network; or if
to do so
would adversely impact upon another person's use of the Service.
We will tell you if we will not block Your Mobile Phone.
You can ask us to unblock Your Mobile Phone that you previously requested us to
block, or unblock Your Mobile Phone where it has been blocked as a result of our
blocking another Customer's mobile handset or device with which it shares the
same international mobile equipment identity (IMEI) number, provided that
you have lawful possession of Your Mobile Phone.
Mobile handset and device blocking always has technical limitations. This means
that there may be a delay between the time that you request Your Mobile Phone to
be blocked and the time that the block is put in place.
We may block any mobile handset or device that you use on the Global Gossip
Mobile Service that is not an Approved Standard Mobile Device.
We may also block any mobile handset or device that we reasonably believe (based
on your usage pattern) that you are using to resell the Service. This will mean
that the device is not able to be used on either the Global Gossip or Vodafone
Networks (except calls to emergency “000” and “112” numbers).
20.
Can we lock your Handset
We can
lock a Mobile Handset that we sell to you to the Vodafone network. If we lock a
mobile handset to the Vodafone network, that mobile handset will only be able to
be used to make or receive voice calls (except calls to emergency "000" and
"112" numbers) or send or receive text messages on the Vodafone Network. To be
able to use the mobile handset on another telecommunications network the device
must be unlocked.
30.
Can I port my phone number to
another carrier?
Yes, you can port your mobile phone
number to another Mobile Service carrier or registered mobile service provider. However, we may charge you an
administrative fee. These charges
are listed in the
“Your Agreement Part 2 – Charges and rates and things that relate to the
charges and rates” and there
must be enough credit on your Global Gossip Card (account) to cover this fee and
any outstanding costs incurred on the service.
Can I
deactivate my Call Line Identification?
Yes, you can deactivate your Call Line Identification in certain circumstances as
described here. Your Mobile Number will be sent to, and will be visible on the
screen of, the phone of each person you make a voice or data call to, unless you
deactivate Call Line Identification either through a function on your Mobile
Phone (if it has the necessary technical capability); or on a call-by-ball
basis, by dialling 1831 before you dial a number.
Should you deactivate your Call Line Identification, you may not be able to make
International Calls on your Mobile phone.
Even if we deactivate your Call Line Identification, your Mobile Number will be
sent to, and will be visible on the screen of, the phone of each person you send
a TXT message, MMS or Video message to, and that the
sending of your Mobile Number with TXT
messages, MMS or Video message cannot be deactivated.
31.
What is the
term of your Agreement and how can it be terminated?

Agreement ends when:
1.
it is
terminated by us or by you in accordance with the Agreement; or

5.
If
you port your phone number to another carrier or Mobile service provider
6.
If
you do or attempt to do any of those things we have listed in this agreement
with you that we have said you CAN’T do
7.
We
may also terminate the Agreement by giving you a reasonable notice (at least 14
days)
If the Agreement is terminated
(either by you or by
us), you may continue to use any credit on your Global Gossip Card for
other services such as internet access or phone card access unless your Global
Gossip Card has also been terminated.
For conditions relating to the use of the Global Gossip Card refer to
globalgossip.com. You agree and
accept that credit you place on your Global Gossip account will NOT be refunded
in any circumstance, other than those circumstances required by law, regardless
of the availability of, or termination of any of the Global Gossip services.
32.
Can
my service be suspended or limited without notice?

addition to the conditions noted above where we can terminate your Agreement,
there are other circumstances where we may limit, suspend or terminate the
service without notice. Although we
will try to give you as much notice as is reasonably practicable, we may, in the
circumstances set out in below immediately (and without notice) suspend or limit
the Service (or any feature of it) for any period we think is reasonably
necessary; or terminate this Agreement.

Your Agreement Part 2 –
Charges and Rates
and
Things that Relate to the Charges and Rates
October 2012
1.
What is this document all
about?
This is the second part of
your Agreement with us and is also a legal document. In it you will find the
information you need about charges and costs.
Where we talk about Global Gossip we will also use “we” or “us” and where
we talk about you we will use “you” or “your”.
2.
Can the charges and rates
change?
Yes. The charges and rates outlined in the
tables below can and will change from time to time. We will try our best to give you 30
days notice of changes to charges. Also, sometimes, you may be eligible to be a
part of a special promotion. Whether
you can be a part of a special offer or promotion will depend on that offer’s
terms and conditions which you will be able to find at
www.globalgossip.com.
3.
What are the Charges for the Global Gossip Mobile Services?
Global Gossip has PAYG rates (Pay As You Go rates)
that apply to your ordinary and general use of your Global Gossip Mobile
Service, and
special rates that apply to
the Animal Packs. If you do not want to purchase an Animal Pack (and there is
information about the Animal Pack below), the
PAYG rates on the attached
table will be the Charges you will pay for the Global Gossip Mobile services.
When you place money on your Global Gossip Card (Top-Up
your account) either when you first get your card from us or when you Top-up
later, the cost of using the Global Gossip Mobile services is deducted from that
credit on your Global Gossip account.
The charges for using the
Global Gossip Mobile Service are listed at the end of this document. We have a summary of these
charges containing details of only the most commonly used services in your
starter pack. That summary is ONLY a
summary and does not list all the rates that apply.
4.
What is the smallest charge
Global Gossip will charge me for?
For outgoing voice calls,
we will charge you by the minute (60 seconds), for SMS by the text (TXT) (160
characters) and for data by 200 KB increments.
If you are using our Mobile
Voice Services, the smallest amount we will charge you for is a minute even if
you have only used a small part of that minute to make a call. We do not charge
you to receive calls.
If you are using our Mobile
TXT services, the smallest amount we will charge you will be for one TXT (160
characters) even if only used 1 character in sending your TXT.
If you are using our Mobile
Data Services, we will charge you for a 200KB even if you have only used 1KB.
5.
What is a Standard Call?
A Standard call is a call to any
Australian landline or mobile number. However, there are some calls and services
that are not Standard Calls and are not charged as Standard Calls: video calls,
international calls, ‘13’, ‘15’ and ‘18’ numbers, 1223-Directory Assistance,
123-Ask us anything and all other premium and special numbers and services.
6.
What is a Standard Text?
A Standard TXT is when you send a
text (TXT) from your mobile phone to any other mobile phone connected to a
public mobile telecommunications network inside Australia. Standard TXT IS NOT a
Premium TXT. The Standard TXT rate applies to Standard TXT sent up to 160
characters per TXT message. If your message is more than 160 characters, each
additional character will be part of a new message up to a maximum of 154
characters per subsequent message, with each subsequent message attracting the
rate appropriate
7.
What is an Animal Pack?
You can use your credit on your Global Gossip account to
buy or opt into any of the Global Gossip
Animal Packs.
Each Animal Pack contains a number of special items (“
inclusions”) and depending on the Animal Pack you buy, you will have access to
these items for either 30 days or when they run out (if they are a fixed number
or quantity), whichever comes first.
To opt into an Animal Pack, you will need to send a
text/SMS to 0410 467 747 or purchase it online
8.
How many Animal Packs can I have at a time?
You can only buy one Animal Pack at a time. If you buy a
second Animal Pack before the first Animal Pack runs out you will lose whatever
is still left inside your first Animal Pack.
The only exception to this is the ‘Datapack’ which is the
purchase of extra data allowance for internet access using your compatible
handset or mobile dongle. ‘Datapack’ will
top-up your current Animal Pack and will expire when your Animal Pack expires.
9.
How long does an Animal
Pack last?
The Animal Packs
last 30 days or until all your inclusions run out, whichever comes first. If any
of the inclusions in the Animal Pack
are unused, they will end 30 days after the
Animal Pack was purchased.
10.
What does an Animal
Pack contain?
The Animal Pack contains
special items (“inclusions”) that depend on what Animal Pack you buy. Those
inclusions are different for every
Animal Pack and are listed at the end of this document for each Animal Pack.
11.
What’s
inside and what is
outside my Global Gossip Mobile
Animal Pack?
Anything listed in the
Animal Pack is a thing
inside that Animal Pack.
The special rates for the things in your Animal Pack apply only to those things
listed
inside your Animal Pack and these are all listed at the end of this
document for each Animal Pack.
Anything that is NOT listed
for that Animal Pack is
outside the Animal Pack.
If what you want to do with your Global Gossip Mobile Service is NOT listed as
inside your Animal Pack, then it is outside your Animal Pack and
the Global Gossip PAYG rates will apply (please check that what you want to do
is not one of those things you can’t do with your Global Gossip Mobile
Service).
12.
My Global Gossip Mobile Service and my
Animal Pack says “Free” or “Unlimited” in relation to some voice services. What
does”Free” or “Unlimited” mean?
Global Gossip Fair Use policy applies to your Free or Unlimited use of the
Service. Free or Unlimited voice services are provided for live dialogue
between two individuals; unreasonable use is any use that is not live
dialogue between two individuals other than retrieving your voicemail for your
Global Gossip Mobile Service.
Using Global Gossip’s Free or Unlimited
voice services for conference calling or any variation of conference calling or
call a number that dials out to a second number (other than to retrieve your
Global Gossip Mobile Services Voicemail), are those things that we list as
“can’t” do in your Agreement with us.
Free or Unlimited voice services can’t
be used for multi-party calling (separate calls initiated by you but not linked
together), monitoring services, data transmissions, transmission of broadcasts,
transmission of recorded material, or other connections that do not consist of
uninterrupted live dialogue between two individuals.
Global Gossip Fair Use policy applies
in circumstances where there is unreasonable use of your Free or Unlimited
Mobile Services. If we find that you
are using its Free or Unlimited voice service plans for anything other than live
dialogue between two individuals we, may at our option, charge a 95¢ per minute
usage fee for all such calls, terminate your service, or change your plan to one
with no free or unlimited usage components.
We will notify you if we intend to
charge the additional fees, change or terminate your service, and you may
terminate the Agreement.
13.
Can I find out what calls and how many I have made and how much money I have left on
my account?
Yes. At any time you can
check how much you still have in your account online at
www.globalgossip.com, by
sending a text message with
“balance” to 0410 467 747 to
or by calling Customer Service on 126
789.
We can also send you a
paper version of your records. There will be a charge $10.00 for each paper
record you request.
